HIPAA protects against certain uses or disclosures of identifying health information in the electronic age. It is supposed to not conflict with state privacy causes of action. This seminar will define the HIPAA privacy rule, discuss patient rights and access to health information, and analyze the HIPAA interplay with privilege, confidentiality and attorney work product. The panel will further highlight difficulties in obtaining health records and discuss examples of when disclosure of protected health information (PHI) is wrongly breached or properly waived.
