About the Program:

Special Needs Law is based on creating a life plan for individuals with disabilities in order to achieve the goal of independent living. But estate planning and elder law attorneys aren’t the only practitioners who should be familiar with Special Needs Law. Attorneys who secure personal injury settlements, spousal and child support awards, and workers compensation settlements for their clients also need to have an understanding of Special Needs Law to protect their disabled clients’ access to public benefits. This program, featuring experts in the area of special needs planning, will review and explore the myriad of legal and practical issues surrounding Special Needs Law.

Estate planning, elder law, family law, personal injury, and workers compensation attorneys with all levels of experience.

  • How to conduct an in-depth evaluation of personal needs and private assets
  • How to draft and administer both third-party and first-party special needs trusts, and distinguish the legal characteristics of each
  • How to establish Medicare Set-a side trusts--an ancillary, but often necessary, type of trust for individuals who receive a settlement from a worker’s compensation claim
